PETITION FOR NEW YORK CITY CHARTER AMENDMENT TO NOT

ENFORCE CERTAIN LOW-LEVEL ADULT MARIJUANA USE AND POSSESSION LAWS

To: City Clerk, City of New York

1)We the undersigned, being duly qualified electors of the City of New York, State of New York, representing not less than thirty-thousand electors, present this petition to the City Clerk of New York and respectfully request that the following proposed local law to amend the Charter of the City of New York be submitted to the voters of the City of New York at the next general election:

A LOCAL LAW

To amend the New York City Charter, limiting the authorized punishment that can be imposed in a New York City Criminal Court for the possession of up to two ounces of marijuana or of marijuana paraphernalia to a maximum $50.00 fine, and eliminating the possibility of jail as a punishment for possession of marijuana.


Be it enacted by the people of the City of New York, pursuant to the authority provided in section 37 of the Municipal Home Rule Law as follows:

The New York City Charter is hereby amended to include:

CHAPTER [__] RECREATIONAL MARIJUANA USE

The authorized punishment that can be imposed in a New York City Criminal Court for the possession of up to two ounces of marijuana or of marijuana paraphernalia is limited to a maximum $50.00 fine, and the possibility of jail as a punishment for possession of marijuana is eliminated.

No city agency or office shall limit or refuse to provide any facility service, program or benefit to any person based upon or by reason of conduct that is made lawful or otherwise made non-enforceable by this subsection.

Nothing in this subsection shall be construed to require any city agency or office, or any employer, to permit or accommodate the use, consumption, possession, transfer, display, or transportation of marijuana in the workplace or to affect the ability of any such agency, office or employer to establish and enforce employment policies restricting the use of marijuana by employees.

Nothing in this subsection shall be construed to permit driving under the influence of marijuana or driving while impaired by use or ingestion of marijuana or to modify or affect the construction or application of any provision of law related to driving under the influence of marijuana or driving while impaired by marijuana.
